The increasing reliance on advanced surveillance technologies by law enforcement agencies, particularly facial recognition software, is under intense scrutiny following a high-profile case of wrongful arrest in New York City. This incident has ignited a fierce debate among civil rights advocates and privacy groups, who are calling for immediate investigations into the New York Police Department’s (NYPD) use of such tools, citing inherent biases and potential for widespread police misconduct.
At the heart of the controversy is Trevis Williams, a Black man who endured two days of wrongful imprisonment after being falsely identified by the NYPD’s facial recognition technology. Williams, who was driving miles away from the alleged sex crime at the time it occurred, told Eyewitness News of his profound anger and stress, highlighting the stark physical discrepancies between him and the actual suspect—discrepancies of eight inches in height and 70 pounds in weight. The only similarities noted were that both individuals were Black men with locks.
Crucially, cell phone location data definitively proved Williams’ alibi, placing him en route from Connecticut to Brooklyn when another man was photographed in Manhattan’s Union Square. Despite this irrefutable evidence, Williams recounted how NYPD officers proceeded with his arrest two months later, relying heavily on the flawed facial recognition match. This stark contradiction underscores the profound unreliability of the technology when applied in real-world policing scenarios.
Legal proceedings eventually saw the case dismissed last month, thanks to the diligent efforts of Williams’ public defenders from the Legal Aid Society. The organization successfully demonstrated that Williams was a victim of mistaken identity, bringing to light the critical flaws within the NYPD’s enforcement strategies. This victory for Williams, however, unveiled a more troubling pattern of false arrests linked to facial recognition data across the city.
In a strongly worded letter to authorities, including Inspector General Jeanene Barrett, the Legal Aid Society detailed alarming claims: that the NYPD is not only relying on facial matches sourced from outside its approved photo database but is also allegedly leveraging other city agencies, like the Fire Department of New York (FDNY), to circumvent legal restrictions placed on its own facial recognition searches. The NYPD, meanwhile, maintains the technology’s proven success, stating it “cannot and will never make an arrest solely using facial recognition technology.”
However, Legal Aid disputes the NYPD’s claims, alleging that the Special Activities Unit (SAU) within the Intelligence Division operates secretly, outside established regulations, and deliberately avoids documenting its illicit activities. Further accusations suggest the FDNY is conducting facial recognition searches that fall beyond the legal confines of NYPD policy. A June court case cited by Legal Aid revealed an instance where the NYPD allegedly used the FDNY to skirt regulations by identifying a suspect in a misdemeanor protest case using Clearview AI and DMV photos.
These incidents underscore a systemic problem rooted in the inherent biases of facial recognition software. As highlighted by the Surveillance Technology Oversight Project (STOP), the technology frequently misidentifies individuals in poor-quality photos and disproportionately targets people of color, women, the young, and the elderly. Albert Fox Cahn of STOP emphasized that due to existing arrest biases in New York, the technology will inevitably and disproportionately target Black, Latino, and Asian individuals, exacerbating racial disparities within the justice system.
Diane Akerman, Staff Attorney with the Digital Forensics Unit at Legal Aid, succinctly summarized the pervasive concern: “Everyone, including the NYPD, knows that facial recognition technology is unreliable.” She contends that the NYPD disregards even its own protocols, which are designed to safeguard New Yorkers from the very real risks of false arrest and imprisonment. Civil rights and privacy groups are now urging elected officials to take decisive action, advocating for an outright ban on the use of this technology by law enforcement, affirming that the NYPD cannot be trusted with such a potent and flawed tool.
